GENERAL CONDITIONS AND TERMS OF USE AND PRIVACY

The following outlines the terms and conditions governing the use of POWER LINK, C.A.’s Digital Streaming Service Platform.

POWER LINK, C.A. is a commercial company registered with the Third Commercial Registry of the Judicial District of the Capital District and the Bolivarian state of Miranda, under No. 84, Volume 18-A, on September 11, 2020, R.I.F. J-50037979-0, headquartered at La Colina Shopping Center, Level C3, Store C3-18, Paseo Los Andes Street, Las Minas Residential Urbanization, Los Salías Municipality, Bolivarian state of Miranda, as stated in General Authorization No. HGTS-00557 issued by the National Telecommunications Commission (CONATEL) on August 18, 2021.

CLIENTS, SUBSCRIBERS, and/or USERS of the Digital Streaming Service Platform are required to carefully read these General Terms and Conditions of Use and Privacy before continuing to browse the platform. By using it, they acknowledge and accept full compliance with the instructions and obligations contained herein.

POWER LINK, C.A., through its internet service, offers CLIENTS, SUBSCRIBERS, and/or USERS a streaming service accessible from Smart TVs, smartphones, or tablets, under strict security, confidentiality, and privacy standards. To that end, POWER LINK, C.A. will implement verification mechanisms to safeguard their data and transactions. These mechanisms include security measures designed to prevent fraud and protect the identity of CLIENTS, SUBSCRIBERS, and/or USERS. The safekeeping and proper use of such information is the sole responsibility of the CLIENTS, SUBSCRIBERS, and/or USERS, as well as any consequences arising from its disclosure or use by third parties. This release of liability also applies to any damages caused by CLIENTS, SUBSCRIBERS, and/or USERS resulting from the misuse of the information.

By using any products or services offered by POWER LINK, C.A. through its Digital Streaming Service Platform, CLIENTS, SUBSCRIBERS, and/or USERS accept the responsibilities arising from such use, such as errors in payment amounts or service subscriptions. Likewise, POWER LINK, C.A. will not be liable for failure to fulfill its obligations due to force majeure, unforeseen circumstances, or acts of authority, particularly in cases of service interruption related to data transmission or the CLIENTS’, SUBSCRIBERS’, and/or USERS’ connection platform.

Through POWER LINK, C.A.’s Digital Streaming Service Platform, CLIENTS, SUBSCRIBERS, and/or USERS can find information regarding the products and services offered, which will be governed by the provisions of the Telecommunications Service Agreement or the individual agreements regulating them, as well as the applicable terms and conditions for promotions.

Furthermore, POWER LINK, C.A. declares that its data, information, and, in general, the products and services it offers are subject to constitutional, legal, and administrative provisions that guarantee the rights to communication privacy, access to personal information, and the rights and obligations of CLIENTS, SUBSCRIBERS, and/or USERS in the provision of telecommunications services.

For this reason, POWER LINK, C.A. undertakes not to release or disclose personal data without the express consent of its CLIENTS and/or SUBSCRIBERS, except when required by competent government authorities authorized under applicable law.

CLIENTS, SUBSCRIBERS, and/or USERS understand that the information stored and made available to the public on POWER LINK, C.A.’s technological platform is considered data messages in accordance with the terms and conditions set forth herein.

The privacy of communications and access to personal information are guaranteed for such data messages. POWER LINK, C.A. declares that data messages are protected by security devices that verify they have not been altered, remain intact during generation, communication, transmission, reception, and storage, and confirm the sender’s identity to prove their origin. Therefore, CLIENTS, SUBSCRIBERS, and/or USERS expressly acknowledge and accept that POWER LINK, C.A. may record data messages, and they recognize the evidentiary validity of such recordings in judicial or extrajudicial proceedings.

The Digital Streaming Service Platform, including all content, software, user interfaces, text, graphics, logos, designs, photographs, button icons, images, video and audio clips, digital downloads, data compilations, and software included on the site and/or delivered to users as part of the service, are the property of POWER LINK, C.A., its licensors, and/or content providers and are protected by copyright, trademark, and other intellectual property laws and regulations.

It is also expressly understood that any digital databases, whether original or not, created to provide products and services containing personal, private, and confidential data of CLIENTS, SUBSCRIBERS, and/or USERS are the exclusive property of POWER LINK, C.A., which holds all economic rights over them. Nevertheless, POWER LINK, C.A. will protect and respect the rights to privacy, honor, and reputation of individuals, as established in the Constitution of the Bolivarian Republic of Venezuela.

In accordance with the General Terms and Conditions of Use and Privacy of the Digital Streaming Service Platform, CLIENTS, SUBSCRIBERS, and/or USERS must expressly notify POWER LINK, C.A., via the mechanisms provided, if they do not wish to receive commercial electronic messages. In such cases, POWER LINK, C.A. must cease such communications and apply the corresponding corrective measures within no more than twenty-four (24) hours.

POWER LINK, C.A., understanding its duty to provide continuous, regular, and efficient services, will make its best efforts to correct any errors on its technological platform, ensuring the personal and family privacy and honor of CLIENTS, SUBSCRIBERS, and/or USERS, who acknowledge and accept this. However, POWER LINK, C.A. reserves the right to suspend access to its technological platform at any time, without prior notice, for maintenance, technical reasons deemed necessary and appropriate, or in cases of force majeure, unforeseen circumstances, or acts of authority. In these cases, no compensation of any kind will be provided by POWER LINK, C.A.

POWER LINK, C.A. reserves the right to modify these General Terms and Conditions of Use and Privacy, and any changes will be published on its Digital Streaming Service Platform to notify CLIENTS, SUBSCRIBERS, and/or USERS.

POWER LINK, C.A. declares that it complies with current regulations on IT security and communication privacy and will establish and adhere to the necessary security, privacy, transparency, and reliability policies to safeguard the interests of CLIENTS, SUBSCRIBERS, and/or USERS as applicable.
